Beta Privacy Notice (Alien Monke Beta Test)

This Beta Privacy Notice (“Beta Notice”) applies when you participate in the Alien Monke beta test (the “Beta”). It supplements the Privacy Policy and Notice at Collection (Alien Monke) (“Main Privacy Policy”). If there is any conflict between this Beta Notice and the Main Privacy Policy, this Beta Notice controls for Beta-only processing.

1. What this Beta Notice covers

This Beta Notice explains how we collect, use, share, protect, and retain information in connection with the Beta, including:

  • your Meta Horizon account email used to grant Beta access;
  • manual video and voice recordings of arranged Beta sessions recorded by us using the LIV tool inside the Game;
  • app logs and related technical diagnostics collected for debugging and improving the Beta build;
  • feedback and communications you choose to send to us about the Beta; and
  • with your separate consent, use of gameplay video from Beta recordings in promotional materials, such as TikTok and other social media.

This Beta Notice applies only to Beta-related processing. The Main Privacy Policy continues to apply to your general use of the Game and related services.

2. Information we collect for the Beta

A) Meta Horizon account email (Beta access)

We collect your Meta Horizon account email to:

  • verify your eligibility for Beta access, including invites and whitelisting; and
  • communicate with you about Beta participation if needed.

B) Manual Beta session recordings (video + voice)

During scheduled, arranged, or otherwise designated Beta sessions, we may manually record video and voice of your gameplay session. These recordings may capture:

  • your in-game voice chat audio (your voice);
  • in-game events and visuals (gameplay video);
  • your in-game identifiers visible in the session, such as an in-game name or platform identifier shown in-game; and
  • context needed to understand bugs, gameplay balance, and user experience during the session.

Important:

  • these are manual recordings of specific Beta sessions that we arrange or designate;
  • this is not continuous background recording of all users at all times;
  • we record Beta sessions only with your consent; and
  • you may choose not to participate in recorded sessions and, where offered, still participate in other forms of Beta feedback, such as written feedback, or you may withdraw from the Beta entirely.

C) Voice communications and recordings by others

During the Beta, in-game voice chat may be audible to other participants in a session.

Except for the manual Beta session recordings described above, we do not state that we record or store your voice audio merely because you use in-game voice chat during ordinary gameplay. Voice communications used for gameplay remain governed by the Main Privacy Policy and the Game’s regular voice functionality.

Please note:

  • other users may record audio, video, screenshots, or gameplay on their own devices;
  • other users may post or share that content on social media, streaming services, messaging apps, or elsewhere;
  • we do not control recordings, screenshots, livestreams, reposts, or posts made independently by other users or third parties; and
  • those third parties process content under their own terms, policies, and practices, not this Beta Notice.

D) App logs (debug data)

We collect app logs and related technical diagnostics to debug and improve the Beta build. Logs may include:

  • technical diagnostics, such as errors, crashes, and performance data;
  • device and app version information;
  • session and network events, including IP address as part of normal network communications; and
  • identifiers necessary to correlate logs with a Beta test session.

E) Feedback and communications

If you provide Beta feedback, we process the content you submit, such as:

  • messages;
  • bug reports;
  • screenshots, video, or other attachments; and
  • other communications you send to us about the Beta.

If you join a third-party community channel for Beta coordination, such as Discord, that platform processes your data under its own policies. We will only process what you choose to send to us through that channel, such as messages, bug reports, and attachments.

3. How we use Beta information

We use Beta information to:

  • grant and manage Beta access;
  • verify invite and whitelist eligibility;
  • debug issues using recordings, logs, and technical diagnostics;
  • improve gameplay, stability, balancing, usability, and performance;
  • review bug reports, reproduce issues, and troubleshoot Beta builds;
  • communicate with Beta participants about Beta participation and support; and
  • with your separate consent, create promotional materials using gameplay video from arranged Beta recordings, such as short clips posted on TikTok and other social media.

4. Promotional materials and social media use

If we use Beta recordings for promotional materials:

  • we will do so only with your separate consent for marketing use;
  • we may use gameplay video and visuals from the recording;
  • we will not use your voice audio in published marketing content;
  • we will not publish your Meta Horizon account email address;
  • we will try to avoid including identifying information beyond what is naturally visible in gameplay; and
  • where reasonably possible, we may blur, crop, mute, or remove identifiers before publication.

If we publish content on social media platforms, such as TikTok, those platforms process published content under their own terms and privacy policies.

Please also understand that if content is posted publicly:

  • copies may persist outside our control, including through reposts, shares, duets, stitches, caching, downloads, screenshots, and third-party archiving; and
  • we cannot guarantee complete removal of content from the internet once it has been publicly posted or re-shared by others.

5. Legal bases (EEA/UK and similar jurisdictions)

Where applicable law requires a lawful basis, we rely on the following:

Consent

We rely on your consent for:

  • recording your Beta session (video + voice); and
  • using gameplay clips from Beta recordings in promotional materials.

Marketing use consent should be treated as separate from recording consent. You may agree to recording for Beta testing purposes without agreeing to promotional use.

Legitimate interests

We rely on legitimate interests for:

  • collecting and analyzing app logs and related technical diagnostics;
  • maintaining, securing, and stabilizing the Beta;
  • troubleshooting bugs, crashes, and performance problems; and
  • reviewing feedback you choose to provide to help improve the Beta.

6. Who receives Beta information

Binary Echo Studio receives and uses Beta information internally for the purposes described in this Beta Notice. We do not sell Beta information.

Service providers may be involved in operating the Game and supporting infrastructure, as described in the Main Privacy Policy.

In addition:

  • if we publish a clip on social media platforms, such as TikTok, those platforms process the published content under their own terms and policies; and
  • we are not responsible for recordings, screenshots, livestreams, reposts, or other sharing by other users, third parties, or platforms outside content that we publish or directly control.

7. Retention

Unless an exception below applies:

  • Beta recordings (video + voice) and app logs are retained for 30 days, then deleted or de-identified; and
  • Beta feedback and related communications may be retained for as long as reasonably necessary to review the Beta, respond to support issues, document permissions, resolve disputes, or comply with legal obligations.

Marketing materials exception

If a recording, or a clip derived from it, is used in marketing materials, we may retain the relevant recording, derivative clip, and related permission records indefinitely to maintain the promotional asset library and document permissions.

If content is posted publicly, copies may persist outside our control, including through reposts, shares, caches, screenshots, downloads, or third-party archiving.

8. Your choices during the Beta

You can:

  • choose not to participate in recorded sessions;
  • choose not to consent to marketing use;
  • request access, deletion, or other rights where applicable law provides them;
  • withdraw consent for recording and/or marketing use; and
  • leave the Beta.

9. How to withdraw consent or leave the Beta

To withdraw consent for recording and/or marketing use, or to leave the Beta, email:

Withdrawing consent:

  • stops future recording and/or future marketing use of your content by us;
  • does not affect processing that already occurred before withdrawal;
  • does not necessarily require deletion of content already incorporated into completed internal debugging records where retention is otherwise permitted by law;
  • may not allow complete removal of content already posted publicly; and
  • does not require third parties, other users, or platforms to delete content they recorded, reposted, or published independently.

Where reasonably possible, we will remove or stop using content that we control after withdrawal of consent for future use.
