Terms of Service (Alien Monke)

Effective Date: March 30, 2026

These Terms of Service (“Terms”) govern your access to and use of Alien Monke (the “Game”) and related services (collectively, the “Service”) provided by Binary Echo Studio (“Binary Echo Studio,” “we,” “us,” “our”), operated by Pavel Tsenev, an individual entrepreneur registered in Georgia.

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1) Important relationship to platform terms

Alien Monke is distributed through the Meta Horizon Store and runs on Meta platforms. Your use is also subject to Meta’s applicable terms, policies, and platform rules. If there is a conflict between Meta’s platform rules and these Terms for platform-controlled features (payments, accounts, store functionality), Meta’s rules may control for those features.


2) Eligibility and age

  • You must be at least 13 years old to use the Service.
  • If you are under the age of majority where you live, you represent that you have permission from a parent/guardian to use the Service.
  • We may restrict or refuse access if we believe you are not eligible.

3) The Service is a high-movement VR game (Safety first)

Alien Monke is a high-movement VR experience. You are responsible for playing safely.

You agree to:

  • Play in a clear, safe physical space with sufficient room, stable footing, and no obstacles.
  • Use appropriate VR boundaries/guardian features.
  • Take breaks and stop if you feel dizziness, nausea, discomfort, pain, or fatigue.
  • Supervise minors and ensure safe conditions.

You understand:

  • VR and vigorous movement may increase risk of collision, falls, strain, motion sickness, or other injuries.
  • You are responsible for your environment, your hardware setup, and your physical condition.

To the fullest extent permitted by law, you assume the risks associated with VR gameplay and your physical activity while using the Service.


4) Accounts, identifiers, and access

  • The Service uses platform identifiers (such as your Meta account identifiers) to operate multiplayer, enforce rules, and provide access.
  • We may assign or display an in-game SupportID to help with support and moderation.

You are responsible for maintaining the security of your Meta account and device.


5) Purchases and virtual content

  • Purchases (IAP/DLC) are handled through Meta. We do not receive your payment card details.
  • Your right to access purchased content may depend on Meta’s confirmation of entitlements.
  • Except where required by law, purchases are non-refundable and governed by Meta’s refund policies.

We may change, rebalance, or remove in-game items/features at any time, including for gameplay fairness, security, or technical reasons.


6) Code of Conduct (Community Rules)

We want Alien Monke to be fun, fair, and safe. You agree to follow these rules:

A) Fair play — no cheats or mods

  • Do not use cheats, hacks, exploits, automation, unauthorized mods, or any third-party tools that provide an unfair advantage.
  • Do not attempt to bypass mechanics or manipulate physics/network behavior to become uncatchable or otherwise break core gameplay.

B) Play in the spirit of fun

  • No trolling, griefing, spawn/route camping designed only to ruin play, intentionally leaving the intended play area/map, or disrupting matches.
  • Do not intentionally abuse movement or map boundaries to destroy the experience for others.

C) Respect other players

  • No harassment, hate speech, bullying, threats, doxxing, sexual harassment, or intentionally making others uncomfortable.
  • No targeting players in a way that is hostile, discriminatory, or abusive.

D) Reporting

  • If you see someone breaking the rules, please report them using in-game reporting tools (if available) or by contacting support with details and your SupportID.
  • Do not file false reports.

Most importantly: be kind, play fair, and have a great time out there.


7) Voice chat and user interactions

If you use voice chat:

  • Your microphone audio is transmitted in real time to other players (via third-party networking/voice services).
  • We do not record or store in-game voice audio as part of the normal Service.
  • Other players may record or stream on their own devices; we do not control that.

You are responsible for what you say and do in voice chat and in-game interactions.


8) Prohibited conduct (additional)

You also agree not to:

  • interfere with the Service (e.g., DDoS, packet tampering, reverse engineering beyond what law allows, malware)
  • access or use the Service to violate laws or others’ rights
  • attempt to access accounts, data, or systems you are not authorized to access
  • use the Service for commercial purposes without our permission (e.g., unauthorized tournaments, resale, paid boosting)

9) Enforcement and moderation

We may investigate suspected violations and take action, including:

  • warnings
  • temporary restrictions (mute, matchmaking restrictions, feature limits)
  • temporary suspension
  • permanent bans
  • removal of content or access

Enforcement may be based on reports, technical indicators, logs, and moderation review. We may act immediately for serious violations or safety risks.

If you believe an enforcement action is a mistake, you may appeal by emailing support@binaryecho.studio with your SupportID and relevant details.


10) Beta tests (if applicable)

We may offer beta builds or playtests. Participation may be governed by additional terms and notices, including a Beta Privacy Notice describing session recording, logs, and consent-based marketing use.

Beta builds may be unstable and may change or end at any time.


11) Privacy

Our collection and use of information is described in:

  • Privacy Policy and Notice at Collection (Alien Monke), and
  • Beta Privacy Notice (if you join a beta).

By using the Service, you acknowledge those notices.


12) Third-party services

The Service may use third-party services (e.g., platform services, networking/voice providers, analytics/telemetry SDKs, backend services). Those providers may process certain data under their own terms and policies. We are not responsible for third-party services outside our control.


13) Intellectual property

We and our licensors own all rights in the Service, including software, artwork, characters, audio, visuals, trademarks, and other content, except where stated otherwise.

You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for non-commercial entertainment purposes, subject to these Terms.

You may not copy, distribute, modify, create derivative works, sell, or exploit the Service except as permitted by law or with our written permission.


14) Feedback

If you provide suggestions, bug reports, or feedback, you grant us a perpetual, worldwide, royalty-free license to use it for any purpose (including improving the Game), without compensation, and without any obligation to you.


15) Service changes, availability, and termination

We may:

  • update, patch, rebalance, or change the Service
  • suspend or discontinue the Service (in whole or in part)
  • restrict access for maintenance or security reasons

We may terminate or suspend your access if you violate these Terms or if we reasonably believe continued access creates risk or harm to the Service or other users.


16) Disclaimers

To the fullest extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE.” We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.


17) Limitation of liability

To the fullest extent permitted by law:

  • Binary Echo Studio will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenues, loss of data, or business interruption.
  • Our total liability for claims relating to the Service will not exceed the amount you paid to us (if any) for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, certain consumer rights, or liability for intentional misconduct where non-waivable).


18) Indemnity

If permitted by your local law, you agree to indemnify and hold Binary Echo Studio harmless from claims arising out of:

  • your use of the Service,
  • your violation of these Terms,
  • your violation of laws or third-party rights.

19) Governing law and disputes

These Terms are governed by the laws of Georgia, without regard to conflict-of-law principles.

Unless your local consumer protection laws provide otherwise, disputes will be brought in the competent courts located in Georgia.


20) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. Continued use of the Service after the effective date means you accept the updated Terms.
